White House Unveils National AI Policy Framework: Key Takeaways for Businesses and Innovators

On March 20, 2026, the White House released its National Policy Framework for Artificial Intelligence, including a sweeping set of legislative recommendations to shape the federal government's approach to AI governance and secure its domination on the global stage. Simultaneously, House Republican leadership—including Speaker Mike Johnson, Majority Leader Steve Scalise, Energy and Commerce Committee Chair Brett Guthrie, Judiciary Committee Chair Jim Jordan, and Science Committee Chair Brian Babin—announced their commitment to working with the Administration to implement this framework through legislation.

This article summarizes the framework's seven key pillars and analyzes their implications for businesses, creators, and legal practitioners advising clients in the AI space.

I. Protecting Children and Empowering Parents

The framework places significant emphasis on child safety measures for AI platforms and services. Key recommendations include requiring AI platforms likely to be accessed by minors to implement commercially reasonable, privacy-protective age-assurance requirements, such as parental attestation. It also urges Congress to empower parents with robust tools to manage their children's privacy settings, screen time, content exposure, and account controls.

Notably, the framework affirms that existing child privacy protections—including limits on data collection for model training and targeted advertising—apply to AI systems. Platforms serving minors would be required to implement features that reduce risks of sexual exploitation and self-harm. Importantly, the framework preserves state authority to enforce generally applicable laws protecting children, including prohibitions on AI-generated child sexual abuse material.

II. Safeguarding and Strengthening American Communities

The framework addresses the infrastructure demands of AI development while protecting communities from potential adverse impacts. In accordance with the Administration's "Ratepayer Protection Pledge," residential consumers should not experience increased electricity costs from new AI data center construction and operation. At the same time, federal permitting for AI infrastructure construction—including on-site and behind-the-meter power generation—should be streamlined to accelerate buildout and enhance grid reliability.

The framework also calls for enhanced law enforcement efforts to combat AI-enabled impersonation scams and fraud targeting vulnerable populations, and for providing AI resources to small businesses through grants, tax incentives, and technical assistance programs.

III. Respecting Intellectual Property Rights and Supporting Creators

A closely watched aspect of the framework concerns intellectual property rights in AI training and outputs. The Administration states its belief that training AI models on copyrighted material does not violate copyright laws, but acknowledges arguments to the contrary and supports resolution of these issues by courts. Accordingly, the framework recommends that Congress refrain from taking actions that would impact the judiciary's resolution of whether training on copyrighted material constitutes fair use.

However, Congress is encouraged to consider enabling licensing frameworks or collective rights systems that would allow rights holders to collectively negotiate compensation from AI providers without incurring antitrust liability—while not addressing when or whether such licensing is legally required.

The framework also recommends establishing a federal framework protecting individuals from unauthorized distribution or commercial use of AI-generated digital replicas of their voice, likeness, or other identifiable attributes. Such a framework would include clear exceptions for parody, satire, news reporting, and other expressive works protected by the First Amendment.

IV. Preventing Censorship and Protecting Free Speech

Congress is urged to prevent the federal government from coercing technology providers, including AI providers, to ban, compel, or alter content based on partisan or ideological agendas. The framework also recommends providing Americans with an effective means to seek redress from the federal government for agency efforts to censor expression on AI platforms or to dictate information provided by such platforms.

V. Enabling Innovation and Ensuring American AI Dominance

The framework strongly emphasizes innovation over regulation. It states that Congress should not create any new federal rulemaking body to regulate AI, but instead support the development and deployment of sector-specific AI applications through existing regulatory bodies with subject matter expertise and through industry standards.

Further, Congress should establish regulatory sandboxes for AI applications and provide resources to make federal datasets accessible to industry and academia in AI-ready formats for use in training AI models and systems.

VI. Educating Americans and Developing an AI-Ready Workforce

Recognizing that American workers must benefit from AI-driven growth, the framework calls for incorporating AI training into existing education, workforce training, support and demonstration, and apprenticeship programs. Congress should expand federal efforts to study trends in task-level workforce realignment driven by AI and bolster capabilities at land-grant institutions to provide technical assistance and develop AI youth development programs.

VII. Establishing a Federal Policy Framework and Preempting Cumbersome State AI Laws

Importantly, the framework's most consequential recommendation may be its approach to federal preemption, which builds on the White House’s December 2025 Executive Order. To prevent a "fragmented patchwork of state regulations" that would hinder national competitiveness, Congress should preempt state AI laws that impose undue burdens and establish a minimally burdensome national standard.

However, the framework states it respects key principles of federalism, and would not preempt: (1) traditional state police powers to enforce laws of general applicability against AI developers and users, including laws protecting children, preventing fraud, and protecting consumers; (2) state zoning laws, including state authority to determine AI infrastructure placement; and (3) requirements governing a state's own use of AI through procurement or public services.

The framework specifies that states should not be permitted to regulate AI development, characterizing it as "an inherently interstate phenomenon with key foreign policy and national security implications." States should also not be permitted to penalize AI developers for a third party's unlawful conduct involving their models.

Business Implications and Next Steps

With House leadership publicly committed to implementation, businesses should anticipate significant legislative activity in the coming months. Companies developing or deploying AI systems should consider the following:

  • Compliance Preparation: Begin assessing current practices against the framework's recommendations, particularly regarding child safety measures, data collection practices, and content moderation policies.
  • State Law Uncertainty: While federal preemption may ultimately provide regulatory uniformity, organizations should continue monitoring state-level AI legislation, as the scope and timing of any preemption still remains uncertain.
  • Intellectual Property Strategy: Rights holders and AI developers alike should closely monitor ongoing copyright litigation and consider their positions on potential collective licensing frameworks.
  • Infrastructure Planning: AI infrastructure developers should prepare to leverage streamlined federal permitting while ensuring compliance with ratepayer protection requirements.
