Lex M. Erwin

Lex Erwin is a Shareholder at Maynard Nexsen who represents general contractors, subcontractors, suppliers, developers, businesses, and individuals in construction litigation, real estate litigation, business and commercial disputes, and commercial arbitration.

Based in the firm’s Charlotte, North Carolina office, Lex has more than two decades of trial, arbitration, and appellate experience. He is known for taking on difficult, high-stakes cases that require aggressive pursuit or defense, and he regularly appears before State Superior Courts, North Carolina federal courts, the North Carolina Business Court, and in arbitrations. Lex is licensed to practice law in both Georgia and North Carolina.

Representative matters include:

• Business Litigation – Shareholder Dispute: Negotiated a win-win settlement after a two-week jury trial involving a dispute between shareholders of a closely held company.
• Real Estate Litigation: Won a two-week jury trial involving a bitterly fought real estate ownership dispute over a Lake Norman waterfront property.
• Business Litigation – Federal Court: Won dismissal of purported $10 million fraud and unfair and deceptive trade practice claims alleged against his client in the Middle District of North Carolina federal court.
• Appellate – Fraud Recovery: Won an appeal in the U.S. Court of Appeals for the Fourth Circuit for clients who were defrauded of more than $1 million, then executed on the defendants’ multi-million-dollar home to obtain payment for his clients.

Lex focuses on his clients’ bottom line, working to achieve the best possible economic result, whether through trial, arbitration, or a negotiated settlement.

During law school, Lex served as a law clerk to Judge Mark Martin of the North Carolina Court of Appeals. He began his legal career at a large international law firm in Atlanta, Georgia.
