Charles K. Chineduh

Charles is a versatile litigator and strategic advisor trusted by clients ranging from entrepreneurs and innovative startups to Fortune 500 companies, including major insurers. Known for his creative problem-solving and meticulous attention to detail, he delivers practical, forward-thinking counsel across a wide spectrum of business and commercial matters—including insurance disputes, healthcare, data privacy, employment, class actions, contractual disputes, business torts, and general corporate matters.

With experience spanning every phase of litigation—from pre-suit strategy through trial and appeal—Charles has successfully represented clients in state and federal courts across the country. Recently, he secured a complete defense trial victory for a healthcare plan in a high-stakes class action seeking over $55 million in damages.

In his insurance practice, Charles represents life, health, and disability insurers in a diverse range of disputes including breach of contract, bad faith claims, punitive damages allegations, and ERISA-governed litigation involving employee benefit plans. He also handles matters involving coverage disputes, fraud and misrepresentation, unfair competition, agent/broker sales practices, as well as claims concerning insurance-related investment products. Beyond the courtroom, Charles designs and delivers training for claims professionals and attorneys on emerging legal trends, claims handling, and policy issues.

• Achieved total defense trial victory for a health plan in a class action lawsuit with over $55M in alleged damages and a proposed class of over 200,000 consumers.

• Advised and successfully represented insurers in high-exposure insurance coverage disputes, claims for bad faith and punitive damages in state and federal courts.

• Successfully represented clients and resolved high-value disputes including in healthcare, data privacy, business torts, employment, as well as contract and commercial disputes.

• Defended insurer in multi-party, 8-figure insurance bad faith action in federal court alleging failure to pay death benefits which also involved conducting international discovery through the Hague Evidence Convention.

• Obtained summary judgment and complete dismissal of all claims including breach of contract and bad faith on behalf of insurer relating to rescission of 7-figure disability insurance policy for material misrepresentations and omissions on the disability insurance application.

• Successfully resolved on behalf of insurers multiple actions involving rescission, lapse and reinstatement, reformation, fraud/misrepresentations by applicants/insureds, claims for unfair competition, actions related to alleged agent misconduct, interpleaders, declaratory relief actions, etc.

• Defended insurers and welfare benefit plans in various manner of ERISA claims for benefits, coverage disputes, equitable relief, and actions alleging breaches of fiduciary duty.

• Obtained summary judgment and complete dismissal of all claims against insurer in action alleging various ERISA violations as well as seeking equitable relief related to 7-figure life insurance claim.

• Represented insurer in bankruptcy adversary proceedings involving claims brought by unsecured creditors.

• Represented life, health and disability insurers at state and federal appellate courts.

• Successfully represented national leading provider of payment processing services in obtaining preliminary and permanent injunction in preventing disclosure of client information pursuant to Public Records Act request.

• Successfully obtained complete dismissal of all claims with prejudice on demurrer on behalf of advertising agency client in case alleging breach of contract.
