Overview

Our attorneys have extensive trial experience in pharmaceutical and biotechnology patent infringement and licensing disputes in the federal courts and in arbitration. Many of our senior litigators represented both branded and generic pharmaceutical clients in Hatch-Waxman patent litigation while at their previous firms. They also have litigated patent infringement and licensing disputes involving biologics. We have successfully argued appeals to the U.S. Court of Appeals for the Federal Circuit. Many of the lawyers on our team are registered to practice in the United States Patent and Trademark Office and represent clients in Patent Office proceedings and trials, including inter partes review (IPR) and post-grant invalidity challenges under the America Invents Act.

Maynard Nexsen’s life sciences litigation clients include biotechnology CDMOs, a large European pharmaceutical company, and pharmaceutical and medical device companies. Life science technologies at issue in litigation handled by Maynard Nexsen include the manufacture of plasmid DNA, antibodies used in the treatment of cancer, small and large molecule pharmaceuticals and medical devices.

Our team includes attorneys with advanced scientific expertise who are able to apply the law to complex scientific and technical issues. They hold Master’s or Ph.D. degrees in life sciences such as molecular biology, environmental sciences or bioengineering. That enables our litigators to simplify the presentation of complex arguments and provide clients with winning results in the courts and in arbitration.
