Recent Wins for Maynard Nexsen’s IP Litigation Team

As reported by Reuters on April 17, 2019, federal district court judge in New Jersey granted our client Askeladden’s motion to dismiss and entered an Order dismissing all of the fraud, civil RICO, business tort and other claims that plaintiff Verify Smart Systems asserted in a patent dispute against the company, its parent company The Clearing House, and against Bank of America and Wells Fargo. Maynard Nexsen’s multi-office team on this matter was led by Kevin Culligan and John Hanish in New York.

In another multi-pronged cross-office effort led by Culligan and Hanish, the Maynard Nexsen patent litigation team successfully defended IBM in two separate actions filed by Dr. Lakshmi Arunachalam, a well known patent troll, in federal court in Delaware and California. In Delaware, the Court granted IBM’s motions to dismiss and entered Orders dismissing with prejudice all of Plaintiff’s claims against IBM. In the California action, the Court dismissed with prejudice all of Plaintiff’s claims against IBM, which like the Delaware case, included claims for patent infringement, civil RICO violations, antitrust violations, fraud and violations of other federal and state laws. These decisions were affirmed by the Court of Appeals for the Federal Circuit in Washington, D.C.
